Disability Access Certificate

A Disability Access Certificate, (DAC), officially certifies that the design of certain works is in compliance with the requirements of Part M of the Building Regulations. Part M of the Building Regulations has direct bearing on the geometrical layout of a building, (e.g. parking, entrances, corridors, lifts, stairs, sanitary facilities, etc). Therefore we advise that, in order to avoid the need for remedial works, the requirements of Part M should be taken on board in the early design stages of a construction project.
If a Fire Safety Certificate is required a DAC may be necessary.
A new building or an existing building may not be opened, operated or occupied unless a DAC (or, a Revised Disability Access Certificate) has been granted by the building control authority.
A Certificate of Compliance on Completion cannot be processed without a DAC, if a DAC is required.

The Building Control (Amendment) Regulations 2018 (S.I. No. 526 of 2018) came into effect on 17 December 2018.
The Building Control (Amendment) Regulations 2018 separates the requirement for a Disability Access Certificate from the requirements for a Fire Safety Certificate, and explicitly specifies the buildings or works, which require/ do not require a Disability Access Certificate with respect to the requirements of Part M (Access and Use) of the Second Schedule to the Building Regulations. The amendment primarily clarifies the application of Disability Access Certificates to existing buildings when brought back into use.
To avoid any doubt, this amendment makes no change to the requirement for a Fire Safety Certificate, which remains as per Part III Fire Safety Certificates. Accordingly, the provisions of S.I. No. 9 of 2014, which requires statutory certification, remain unchanged. Please contact our Fire Services regarding Fire Safety Certificates.
In relation to Article 20D (2)(a) to (d), it should be noted that the exemption for a DAC equates to the same building types which are currently exempted from the requirements for a Fire Safety Certificate, as specified in Article 11(2). However, the exemption for a DAC is irrespective of storey height.
In addition, Article 20D (2)(e), clarifies that a DAC is not required for a building used solely to enable inspection, repair or maintenance of fixed plant, building services, or machinery, such as access to roof top air handling units or electric substations.
It is also not required for the Material Alteration to a flat, the extension to a flat or a material change of use as defined by Section 3(3) of the Act.
A DAC is also not required where there is no requirement of Part M of the Second Schedule to the Building Regulations.
